But farm owners and residents who live on the property told a\r\nDallas-Ft. Worth NBC station that the real reason for the law\r\nenforcement exercise appears to have been code enforcement. The\r\npolice seized &#8220;17 blackberry bushes, 15 okra plants,<!--more--> 14 tomatillo\r\nplants &#8230; native grasses and sunflowers,&#8221; after holding residents\r\ninside at gunpoint for at least a half-hour, property owner Shellie\r\nSmith said in a statement. The raid lasted about 10 hours, she said.\r\n<\/p>\r\n<p>\r\nLocal authorities had cited the Garden of Eden in recent weeks for\r\ncode violations, including &#8220;grass that was too tall, bushes growing\r\ntoo close to the street, a couch and piano in the yard, chopped wood\r\nthat was not properly stacked, a piece of siding that was missing\r\nfrom the side of the house, and generally unclean premises,&#8221; Smith&#8217;s\r\nstatement said. She said the police didn&#8217;t produce a warrant until\r\ntwo hours after the raid began, and officers shielded their name\r\ntags so they couldn&#8217;t be identified. The situation came to a\r\nboil on Friday, August 2nd of 2013 when an early morning SWAT raid\r\nwas conducted by the Arlington Police at the Garden of Eden, during\r\nwhich the grass was cut and many trailers full of materials were\r\nremoved from the premises by the City.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nIt&#8217;s not just that the SWAT team was there to mow the grass.\r\nAccording to the farmer,\r\nthe city of Arlington had agreed beforehand not to take action against the farm about the citations,\r\nand the farmer had <strike>aplealed<\/strike> appealed to the sheriff to ensure that.\r\nInstead the sheriff raided the farm:\r\n<blockquote>\r\n<p>\r\nIn her lawful notifications on record to the County Sheriff, Dee\r\nAnderson, Smith declared that her safety and property were being\r\nthreatened unlawfully by the City and individuals in their official\r\nand individual capacity and that her family was in danger. She\r\nrequested that the Sheriff intervene on her behalf to see that due\r\nprocess of law was followed. However the Sheriff did not respond nor\r\ndid anyone from the Sheriff&#8217;s office.\r\n<\/p>\r\n<p>\r\nAccording to established, lawful documentation filed with the\r\nArlington Municipal Court, the City of Arlington has made prior\r\nagreement with the Inhabitants of the Garden of Eden that this issue\r\nwas already resolved. There are multiple signed, bonafide documents\r\non the record wherein the City agrees that they neither could nor\r\nwould take action of any kind in the matter of the city code\r\nviolations at the Garden of Eden.\r\n<\/p>\r\n<p>\r\n<a href=\"http:\/\/www.wfaa.com\/news\/local\/tarrant\/Owners-irked-after-raid-on-Arlingtons-Garden-of-Eden--219354841.html?gallery=y&#038;img=2&#038;c=y\">\r\n<img decoding=\"async\" style=\"float:right;border:none;width:300px\" src=\"http:\/\/media.wfaa.com\/images\/600*338\/0812_garden_eden03.jpg\"><\/a>\r\nYet those agreements were disavowed then the City conducted their\r\nraid and forcibly took action to abate the alleged city code\r\nviolations. Furthermore, due process of law was NOT followed in\r\nenforcing code compliance at the Garden of Eden. There was never any\r\ntrial to bring evidence or give testimony before a judge and jury,\r\nas is every man and woman&#8217;s right under the law. Instead, several\r\ndozens of government employees, paid by the people, showed up\r\nunannounced, uninvited, raped the land and held captive every human\r\npresent at gunpoint.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nHint: this is not marijuana.\r\n<p style=\"text-align:center\">\r\n<a href=\"http:\/\/intothegardenofeden.com\/index.php?option=com_content&#038;view=article&#038;id=87&#038;Itemid=325\">\r\n<img decoding=\"async\" style=\"border:none;width:500px\" src=\"http:\/\/intothegardenofeden.com\/images\/stories\/galleryfacesphotos\/meandbasil.jpg\"><\/a>\r\n<p>\r\nAa MSNnow put it,\r\n<a href=\"http:\/\/now.msn.com\/garden-of-eden-farm-raided-by-cops-who-confused-pot-and-tomatoes\">\r\nTexas cops can&#8217;t tell their tomatoes from their THC<\/a>.\r\n<p>\r\nBen Russell of NBCDFW.com Wednesday\r\n<a href=\"http:\/\/www.nbcdfw.com\/news\/local\/Arlington-Farm-Owners-Demand-Apology-From-Police-After-Drug-Raid-Comes-Up-Empty-219520531.html\">\r\nposted video<\/a> including\r\nthe pages of items seized recorded by the cops, &#8220;none of which was marijuana&#8221;.\r\n<blockquote>\r\n<p>\r\n&#8220;We had mass amounts of materials taken,&rdquo; Eaker said.\r\n&ldquo;If you saw the list, it&#8217;s pages and pages and pages of\r\nmaterials taken. That wasn&#8217;t junk. That wasn&#8217;t trash.&#8221;\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nAccording to the sheriff&#8217;s departement:\r\n<blockquote>\r\n<p>\r\nThe handcuffs are standard procedure during the search of suspected\r\nnarcotics operations, according to Sgt. Christopher Cook of the\r\nArlington Police Department. Tactical officers assisted in the\r\nexecution of the search warrants to secure the location so narcotics\r\ndetectives could safely enter the property, police noted in a\r\nstatement to NBC 5.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nGot that?\r\nIf you are merely suspected of a &#8220;narcotics&#8221; operation, a SWAT team\r\ncan come to your house and handcuff you for the safety of &#8220;narcotics detectives&#8221;.\r\nNevermind your family&#8217;s safety.\r\nThen the cops can take massive amounts of your possessions.\r\n<p>\r\nWhy the suspicion?\r\n<blockquote>\r\n<p>\r\nIn June, an anonymous source provided police with information that\r\nEaker was growing marijuana in a garden that is surrounded by\r\nbamboo, the warrant states.\r\n<\/p>\r\n<\/blockquote>\r\n<p>\r\nThat&#8217;s right: an anonymous tip is enough to get you raided by a SWAT team.\r\n<p>\r\nNow this was Arlington, Texas.\r\nWe can hope local law enforcement isn&#8217;t this stupid.\r\n<p>\r\nWhy are cops anywhere still raiding anyone for marijuana?\r\nAren&#8217;t we tired yet of paying to lock people up for victimless crimes\r\nwhile we supposedly can&#8217;t afford education?\r\n<\/p>\r\n<p>\r\n -jsq\r\n<\/p>","protected":false},"excerpt":{"rendered":"An anonymous tip was the basis for a warrant for a SWAT team to hold small farmers at gunpoint in handcuffs while the cops took their okra and tomatoes and code compliance officers mowed the grass.
