<\/td><\/tr><\/table>\nThe 83 family farmers, small and family owned seed businesses, and\nagricultural organizations challenging Monsanto\u2019s patents on genetically\nmodified seed filed papers in federal court (13th August 2011) defending\ntheir right to seek legal protection from the threat of being sued by\nMonsanto for patent infringement should they ever become contaminated\nby Monsanto\u2019s genetically modified seed. The\n Public Patent Foundation\n(PUBPAT)<\/a> represents the plaintiffs in the suit, titled Organic Seed\nGrowers & Trade Association (OSGATA), et al. v. Monsanto and pending\nin the Southern District of New York. The August 13 filings respond to\na motion filed by Monsanto in mid-July to have the case dismissed. In\nsupport of the plantiffs\u2019 right to bring the case, 12 agricultural\norganizations also filed a friend-of-the-court\n\namici brief.<\/a>\n

\n\u201cRather than give a straight forward answer on whether they would sue\nour clients for patent infringement if they are ever contaminated by\nMonsanto\u2019s transgenic seed, Monsanto has instead chosen to try to deny\nour clients the right to receive legal protection from the courts,\u201d\nsaid Dan Ravicher, PUBPAT\u2019s Executive Director. \u201cFilings include\nsworn statements by several of the plaintiffs themselves explaining to\nthe court how the risk of contamination by transgenic seed is real and\nwhy they cannot trust Monsanto to not use an occurrence of contamination\nas a basis to accuse them of patent infringement.\u201d\n<\/blockquote>\nThis goes well beyond control of seeds, of course, and beyond the plaintiffs:\n\n\n

\nIn their brief, the amici describe some of the harmful effects of\ngenetically modified seed and how easily GMOs can contaminate an organic\nor conventional farmer\u2019s land. The organizations filing the amici brief\nwere Farm and Ranch Freedom Alliance, Biodynamic Farming and Gardening\nAssociation, Carolina Farm Stewardship Association, Ecological Farmers of\nOntario, Fair Food Matters, International Organic Inspectors Association,\nMichigan Land Trustees, Natural Environment Ecological Management,\nNebraska Sustainable Agriculture Association, Organic Council of Ontario,\nSlow Food USA, and Virginia Independent Consumers and Farmers Association.\n<\/blockquote>\nThe\n\narticle<\/a>\ncontains links to all the relevant legal materials.\n
